末弘厳太郎(1888–1951)は、日本の法学者。東京帝国大学教授として民法、労働法、法社会学を研究し、条文や概念だけで法を理解する従来の学問を批判して、判例と社会生活の実態を重視する「生ける法」の研究を進めた。日本における労働法学の基礎を築き、第二次世界大戦後は労働三法の立案に参画するとともに、中央労働委員会の初代会長として労働争議の調整にあたった。『嘘の効用』では、社会の変化に合わなくなった法が形式を維持するために、解釈上の擬制という「嘘」を必要とする場合があることを示し、法の建前と現実とのずれを平易な文章で論じている。
Izutaro Suehiro (1888–1951) was a Japanese legal scholar whose work encompassed civil law, labor law, and the sociology of law. As a professor at Tokyo Imperial University, he challenged approaches that treated law as a self-contained system of statutes and concepts, emphasizing judicial decisions and the “living law” found in actual social relations. He helped establish labor law as a field of study in Japan, contributed to the drafting of the country’s postwar labor legislation, and served as the first chairman of the Central Labour Relations Commission. In “Uso no Koyo,” a collection named for an essay meaning “The Usefulness of Lies,” Suehiro explains how legal fictions can allow an outdated rule to accommodate new social realities, exposing the gap between the formal language of law and the way law operates in practice.
